What’s been going on at Johnson & Bennett in 2020

What’s been going on since the beginning of the year. Everyone has been affected by COVID 19. Our office had been working less hours and with less staff. We are working on being back to normal operations by July 1st, but each of us are on different time tables for days and hours in the office versus working remotely. Going forward, we are dedicated to making sure our clients and staff are protected to the best of our ability. We may set up telephone conferences, video conferences, and other means to communicate with you and others. Email is the best option to be sure we hear from you for now and all of our emails follow at the end of this update. Safety is paramount in our lives and we apply the same philosophy to those we encounter, whether client, prospective client, or anyone with whom we interact.

Time has taken on a new dimension. It’s hard to believe we’re essentially halfway through the 2020 year. When we began the year, we had two trials set in February and lots of late nights to be sure we had everything prepared for pre-trial filings as they came due in mid-January, the first week of February, and up to and including trial. This doesn’t account for the dispositive motion filings in December, nor the other files needing attention, nor the normal routine of processing ongoing matters. We sometimes wondered if there was a light at the end of the tunnel. Two trials set in February meant there was no let up in work. Litigation and trial prep became our all encompassing to do lists. Two cases, both TN Western District matters, not very similar in facts, evidence, value, Defendants, or any real other issues. Yes, both had disability discrimination and retaliation claims, but the facts, damages, clients, and proof could not have been more diametrically opposed.

Trials so close together means cases filed close in time. Employment law claims and time lines are inextricably tied to the Dismissal and Notice of Suit Rights issued by the EEOC. We at Johnson & Bennett seem to have a knack for all of our Right to Sue (RTS) notices falling close in time to one another, yet this does not affect our prosecution of our clients’ cases. Working through the EEOC is something we are very familiar with and we know how to navigate the administrative process before you can file suit. There are so many different idiosyncrasies in employment discrimination and retaliation claims that each case must be assessed on its own facts. Employment claims are very fact specific.
